Decision Granting Temporary Protection in the Republic of Serbia
The Decision on the Temporary Protection in the Republic of Serbia of Displaced Persons from Ukraine (“Official Gazette of RS”, No. 36, hereinafter the “Decision”) was rendered by the Government of Serbia on 18 March 2022, and the temporary protection shall last until 18 March 2023.
The Decision applies to citizens of Ukraine and their family members who all resided in Ukraine, asylum seekers, stateless persons, and foreign nationals who have been granted asylum or equivalent protection in Ukraine and their family members who have been granted residence in Ukraine, as well as foreign nationals who have been granted valid permanent residence or temporary residence status in Ukraine and who cannot return to their country of origin.
According to this Decision, the temporary protection applies to citizens of Ukraine and their family members who legally resided in Serbia as at the date of the Decision, if their residence permit expired before the expiry of this Decision.
The rights of persons granted this protection are more closely prescribed under the Law on Asylum and Temporary Protection (“Official Gazette of RS”, No. 24/2018) and include the right to residence, personal identity document, education, access to the labor market, and health care in accordance with regulations governing the rights of foreign nationals.
